    ...the FBI to "get his sentence over with."



    When the Wal-Mart employees in La Grande saw the store's ATM covered with a blue tarp, they figured it was broken.

    Ronald Terry McElvain allegedly knew otherwise.

    Federal authorities have accused the 39-year-old La Grande man of stealing the machine, then spending the $60,000 inside it before calling the FBI last week to ask how long he'd spend in jail for the crime.

    After more than three months on the run, McElvain was arrested late Tuesday evening in La Grande and taken to the Union County Jail. Prosecutors say he may face up to 10 years in prison.

    The heist, as described in an FBI affidavit filed last Thursday in U.S. District Court in Umatilla County, allegedly began the morning of Nov. 29. About 7:30 a.m., McElvain walked into Wal-Mart with a handcart. The ATM, however, was too heavy. Ten minutes later, he returned with a friend, Shane Giese. The two men wheeled the tarp-wrapped ATM out of the store.

    As they strained to lift the machine into a Nissan Pathfinder sport utility vehicle, part of the tarp lifted. Giese glanced in. It was no gun safe, as McElvain had told him earlier. Giese refused to help any further, forcing McElvain to leave the ATM on the parking lot curb, the affidavit said.

    The job, it seemed, would require a more specialized device.

    The next day, authorities visited McElvain's parents. McElvain's mother, Ida, told authorities her son and another man had been at their La Grande home the previous day working in their shop most of the afternoon. Ida McElvain, the affidavit said, couldn't understand why her son had taken the popcorn cooker, a large, heavy cauldronlike object, off his tilt trailer.

    Two days later, authorities returned to the older McElvains' residence. In the back yard, piled near some junk, they saw the popcorn cooker and tilt trailer. Next to the trailer, they noticed an object covered with a tarp. Lifting the corner of the tarp, they spotted a lock, key and ATM instruction card. Later, with search warrant in hand, they seized the top section of an ATM, along with placards and a plastic top cover.

    On Dec. 7, the Union County sheriff's office received a call from Jim Magill, McElvain's cousin in Meridian, Idaho. According to the affidavit, Magill explained how he had received a call from McElvain on the evening of Nov. 29, asking Magill if he could give him a ride to OHSU Hospital in Portland to take care of a medical problem.

    Magill agreed. They drove to Portland that night, staying overnight at the Troutdale Motel 6, the affidavit said. The next day, McElvain stopped at Division Street Auto Wholesale and picked out a white Ford Explorer. He paid with cash taken out of a backpack.

    Later that month, authorities recovered the bottom part of the ATM from a commercial storage unit in La Grande. A hole had been cut out of it.

    On Feb. 28, McElvain called the FBI office in Pendleton. According to the affidavit, McElvain asked about the jail term for taking the ATM. He was nearly out of money and wanted to get his sentence over with, the document said.

    During the conversation, McElvain described a white film -- residue from oven cleaner -- that he used to wipe away fingerprints after he cut open the ATM, according to the affidavit.

    McElvain has a record of brushes with the law. In 1996, he was sentenced to two years in prison on each of two felony charges, first-degree theft and second-degree burglary. He still was on probation.

    "We don't know anything," Herbert McElvain said by telephone about his son's actions.

    "We're completely in the dark," Ida McElvain added.

    Meanwhile, a La Grande Wal-Mart operator said Wednesday the store had an ATM in working order.
