    A day after a warrant was issued for his arrest, D12 member Swift was sentenced yesterday (April 20) to 93 days in jail for violating terms of his probation in a drunken driving case.

    As SOHH previously reported, Swift (born Ondre Moore) failed to make a court appearance on April 20 following the funeral of his slain group mate Proof where he was serving as an honorary pallbearer.

    Swift was due in court on Wednesday afternoon (April 19) for a hearing which would determine whether he violated terms of his probation stemming from a drunken driving case.

    The rapper had been ordered to stay away from drugs and alcohol after pleading guilty last October to an operating a vehicle while visibly impaired charge. Since then, he had tested positive twice for drugs and alcohol and has spent several days in jail.

    According to authorities, Swift was found near his Novi, Michigan home and was escorted by police to the court where Judge Mackenzie, who issued the arrest warrant, sentenced him to 93 days in the Oakland County Jail, with 10 days credit for time he previously spent in jail for the same offense.

    In related news, Mario Etheridge, the C.C.C. nightclub bouncer who shot and killed Proof after the rapper pistol whipped and shot his cousin, Keith Bender, is expected to attend his preliminary hearing on next Wednesday (April 26).

    Etheridge, who is currently in custody after turning himself in a day after the shootout occurred, is charged with two counts of possession of a concealed weapon and discharge of a firearm in a building but not Proof's murder. He plead not guilty to both charges when he was arraigned this past Saturday and is facing up to nine years in prison, if convicted.

      Judge sends rapper to Oakland jail

      Rap group member Swift was thrown in jail Thursday afternoon on a probation violation after Novi police found him and escorted him to court.

      Swift, formerly known as Ondre Moore, became a fugitive Wednesday when he failed to appear in court and 52-1 District Judge Brian MacKenzie issued a warrant for his arrest.

      His initial court date was set for Wednesday, the same day as rapper Proof's funeral.

      Proof and Swift were members of the same rap group, D12.

      Last week, Swift tested positive for drinking alcohol, which he was ordered not to do during probation, said MacKenzie, who waited until 4 p.m. Wednesday for him to show up before signing the arrest warrant.

      Novi police said they found Swift near his Novi home. Police allowed him to drive himself to court, where at about 3 p.m., MacKenzie sentenced him for violating his probation.

      MacKenzie gave Swift the maximum sentence the law allows -- 93 days in the Oakland County Jail, with 10 days credit for time he previously spent in jail for the same offense.

      Swift's attorney David Gorosh did not return two telephone calls from the Free Press seeking comment.

      Swift was on probation because he pleaded guilty to operating a vehicle while visibly impaired last year.

      MacKenzie's law clerk, David Bowman, said Swift, 31, appeared contrite.

      Bowman said Gorosh told MacKenzie in court that Swift did not appear in court Wednesday because Proof's funeral ran long, and Swift did not turn himself in earlier because he was making preparations to go to jail and "he felt his fate was already sealed."

                Yes, he "only" has to do 83 day. Even so I thought he has done 9 days so far, once a week and the other time 2 days. But looks like he has done 10.

                I hope they come back stronger. What doesnt kill you only can make you stronger.

                    Yep, and all the people who are saying he just would have needed to contact the Judge are stupid. One of the Articles says he didnt make it to the court date because of the running long. The funeral was delayed something between 45 minutes and an hour, otherwise he maybe would have made it. Should he have called the Judge during the funeral?

                      judge made it seem that he didnt care. it was his "duty" to show up the court date, which i understand but cut swift some slack...no one expected proof to pass away.

                        Exactly, how should he have known it. And delaying a court date probably isnt possible from one second to the next. Its right that he has to be punished in some way but missing the court date because of the funeral probably made it worse and thats just wrong.

                              or better yet, a week after! Ugh ppl with no heart.
