    A Tesora High School student accused of conspiring with a classmate to break into a classroom to steal a test in preparation for an exam has been released on his own recognizance, following his initial appearance Wednesday afternoon at the Newport Beach courthouse.

    But 18-year-old Tanvir Singh of Ladera Ranch did not enter a plea. His arraignment was postponed until July 8.

    He faces one felony count each of conspiracy, burglary, computer access and fraud, as well as attempted altering of a public record, said Farrah Emami of the Orange County District Attorney's Office. He faces up to three years in prison if convicted, she said.

    Authorities said that in May, Singh broke into a classroom to steal a test from an English teacher's computer.

    "Kids are kids. Sometimes they do things just to see if they can. He certainly didn't need to do it," said defense attorney Marlin Stapleton.

    Co-defendant Omar Khan, 18, of Coto de Caza, is scheduled to be arraigned Thursday. He is accused of hacking into computers at the school and changing grades on college transcripts.


    Omar Khan, 18, of Coto de Caza, will face 34 felony counts when he is arraigned at 9 a.m. on Thursday in Harbor Justice Center. Khan, who should have graduated Wednesday with the rest of his class at Tesoro High School, is being held in lieu of $50,000 bail and faces up to 38 years and four months in prison, Emami said.

    "We found out about it when he asked for a transcript and was in a hurry. We saw the grades were not what he was receiving before," said school principal Don Burch.


    Between Jan. 23 and May 20, Khan allegedly broke into locked rooms at the Rancho Santa Margarita high school, where he was a senior, on several occasions late at night and on weekends to access school computers and change his grades, as well as scores on Advanced Placement tests and school records from previous semesters, Emami said.

    Khan also stole personal log-in information from teachers to gain access to their computers and grades, primarily changing his own grades, but also altering the permanent transcript grades of a dozen other students, Emami said.


    On April 18, Khan allegedly cheated on an English class on a test, leading his teacher to seize the test and give Khan a failing mark, Emami said.

    The test was turned over to the assistant principal, and that weekend, Khan allegedly broke into the school official's locked office and stole back the test in an attempt to conceal the evidence of cheating, Emami said.

    The day before, Khan allegedly broke into a locked room at the high school late at night and accessed a registrar's computer, using a stolen staff member's user name and password to access the Capistrano Unified School District grade database.


    Khan is accused of changing a series of grades and installing spyware on the computer to allow him to access the system from other locations, Emami said.

    About 1 a.m. on April 21, Khan allegedly broke into a locked room at the high school and changed grades on his transcripts to increase his grade point average. A few hours later, he allegedly requested a copy of his official transcripts in order to appeal a denial of admission to the UC system for the fall semester, Emami said.

    Later that night, Khan broke into he school again, changing more grades and backdating a time stamp on the changes to cover up his crime, Emami said.


    School administrators, who noticed a discrepancy in Khan's grades after he requested a copy of his official transcripts, alerted law enforcement.

    Khan was found with original tests, test questions and answers, and copies of his altered grades. He is accused of stealing master copies of tests, some of which were e-mailed to dozens of advanced placement students, Emami said.

    Singh, according to Emami, exchanged several text messages with Khan on May 19, detailing how the two planned to break into the school that evening to steal a test from a specific teacher in preparation fir an exam the next day, Emami said.


    They met at the school and broke into a classroom, but fled after a custodian saw them trying to access a teacher's computer, Emami said.

    Prosecutors said they believe the students were trying to better their chances of college admission.

    Singh and Khan were not permitted to join the Tesoro High School graduation ceremony Wednesday night.

    i remember sneaking tests out in grade 11 bio...that was hilarious...our teacher would just leave it lying around in the open basically.

                    Two things, this dude has a bright future. If he don't end up working for the FBI, he'll be working in computer security in a private corporation and making big bucks, so no need to cry for him. If I were a recruiter reading this, I'd mark his name, especially if I worked for FBI or CIA or some state or fed. agency.

                    Secondly, again, shows what's wrong with the justice system. The worst thing you can do is sell crack, or break into computers, and such. But a little rape and murder is not THAT serious........just don't smoke weed.......
